Terms of Service

Welcome to monfse.com ("Monfse", "we", "our", or "us"). These Terms of Service ("Terms") govern your use of the Monfse website, web applications, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

1. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction, and legally permitted to use the Services under applicable law.

2. Accounts and Security

  • • You must provide accurate and complete information when registering for an account.
  • • You are solely responsible for maintaining the confidentiality of your login credentials.
  • • You agree to notify us promptly of any unauthorized use of your account.

3. Permitted Use of Services

You agree to use Monfse's Services only for lawful and research-related purposes. Prohibited uses include:

  • • Sharing, distributing, or reselling copyrighted PDFs
  • • Uploading material for which you do not have lawful access rights
  • • Circumventing access controls or licensing terms

Monfse accepts uploads only from users who have already lawfully obtained a PDF (e.g., through an institutional subscription, open-access license, or personal purchase).

Uploaded PDFs are stored in encrypted, access-controlled vaults tied to the uploader's account. Files are never publicly accessible or shared with other users.

Within that personal vault, Monfse's Services may perform computational analysis on uploaded files for the sole purpose of:

  • • Extracting bibliographic metadata
  • • Enabling the user to read or search their own text

No full documents are ever indexed across users or made available beyond the individual uploader's session.

This limited, non-public use aligns with U.S. fair-use precedent (e.g., Authors Guild v. Google, HathiTrust) and with the EU DSM Directive's text-and-data-mining exceptions (Articles 3-4), and it complies with standard TDM clauses found in major publisher licensing agreements (e.g., Elsevier, Springer Nature, Wiley, IEEE).

4. Intellectual Property

All platform content and functionality are the property of Monfse Inc. or its licensors. You are granted a non-exclusive, revocable license to use the Services for personal or academic research. This license does not transfer ownership or grant reuse rights beyond the Services.

5. Subscriptions and Payments

Certain features of the Service require a paid institutional subscription. Unless otherwise agreed in writing, subscriptions renew automatically at the end of the applicable term unless notice of non-renewal is provided in accordance with the Agreement. Pricing and payment terms are set forth in the applicable order form or agreement. The subscribing institution is responsible for managing subscription terms and providing timely notice of changes.

6. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms.

7. Privacy and Data Protection

We process your data in accordance with our Privacy Policy. Any PDFs uploaded to monfse.com are encrypted at rest and access-controlled. We do not store, index, or share your uploaded full-text files beyond your own authenticated session. For more details, refer to our Information Security Policy.

8. Disclaimers and Limitations

The Services are provided "AS IS" and "AS AVAILABLE." We do not guarantee uninterrupted access, data accuracy, or fitness for a particular purpose. To the fullest extent allowed by law, we disclaim liability for indirect or consequential damages arising from your use of the Services.

9. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

10. Revisions to These Terms

We may update these Terms at any time. Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms. Updates will be posted below in the "Change Log."

Material changes will be communicated via email or in-app notification, where required by law.
